Rental Terms
All vehicle rentals are governed by a Rental Agreement, which you will receive upon booking confirmation or when collecting the vehicle. This agreement outlines the specific terms, conditions, insurance information, fees, and your obligations for the rental period. In cases of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Renting a vehicle requires:
- To rent a vehicle in Wishaw, you must be at least 21 years old, though age restrictions may differ based on the vehicle type, with extra fees applicable for drivers under 25. A valid, full driving licence is required, held for the minimum period stated in the Rental Agreement. You will also need to present valid identification and proof of your current address, along with valid payment information and a security deposit. Booking and Payment Details
- Reservations can be made via our website, by telephone, or directly at our Wishaw branch. A deposit may be needed to confirm your booking. The remaining balance and security deposit are generally payable upon collecting your vehicle. All prices are listed in British Pounds (£) and include VAT where applicable. We accept major credit and debit cards, processed securely through trusted payment providers.
Vehicle Pickup and Drop-off
- At the time of vehicle collection in Wishaw, it is essential to conduct a thorough inspection and report any pre-existing damage without delay. You will complete and sign a vehicle condition report to document this. Upon return, the vehicle should be in the same condition, accounting for normal wear and tear. Any new damage will be evaluated and may result in additional charges. Ensure the vehicle is returned with the same fuel level as when it was collected; otherwise, refueling fees will apply. You remain liable for any damage or loss up to the excess amount unless additional insurance is purchased. Damage resulting from negligence, misuse, or violation of these Terms will be your responsibility regardless of insurance coverage.
Cancellation and Modifications
Cancellation and amendment policies differ based on the type of booking and the notice period provided. For precise information, consult your booking confirmation or Rental Agreement. Please be aware that late cancellations or failure to show up may incur additional charges.
7. Restricted Activities
Prohibited Uses of Rented Vehicle
- The vehicle must not be used for any unlawful activities. This includes racing, off-roading, or other risky driving practices. Transporting hazardous materials is prohibited. Sub-letting the vehicle or permitting unapproved drivers is not allowed. Driving under the influence of alcohol or drugs is strictly forbidden. The vehicle should only be used for its intended purpose, adhering to passenger and weight limits. Operating the vehicle outside of the agreed geographical boundaries without prior authorization is not permitted.
Breach of these terms may lead to rental cancellation and extra fees.
8. Liability Restrictions
To the fullest extent allowed by English and Welsh law, Car Hire Wishaw will not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business, resulting from your use of our services. Our total liability for any claims is limited to the amount you paid for the rental in the previous 12 months. This limitation does not apply to liability for death or personal injury resulting from negligence or fraud.
9. Applicable Law
These Terms are governed by the laws of England and Wales. Disputes will be handled exclusively by the courts of England and Wales.
10. Terms Updates
We reserve the right to update these Terms at any time. Changes take effect immediately upon being posted on our website. Continued use of our services indicates acceptance of the revised Terms.
